    • The website SpicePioneer.com (“the website”) is owned by Seasoned Pioneers. References to “we”, “us”, or “our” are references to Seasoned Pioneers.  We are a company registered in England and Wales (company number 04108577) and our registered office and address for correspondence is: Unit 8, Stadium Court, Stadium Road, Plantation Business Park, Bromborough, CH62 3RP.
    • Your use of our website and purchase of any products whether individual products in the website “members shop” or via a subscription service is subject to these Terms and Conditions. By accessing our website you agree to our Terms and Conditions.
    • We reserve the right, with or without notice to you, to change our Terms and Conditions at our sole discretion. Your use of the website after changes are made means that you agree to be bound by those changes.
    • You can find the specific details regarding your purchase and subscription with The Spice Pioneer including your scheduled delivery, by logging into your account and clicking on the relevant section of the website.
    • In addition to these Terms and Conditions our Privacy Policy also applies to your use of the website and is incorporated by reference to these Terms and Conditions.
  2. Website Use
    • You agree not to upload, post, email or otherwise send or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, harm, damage, destroy or limit the functionality of any computer software or hardware or equipment linked directly or indirectly with this website. You also agree not to interfere with the servers or networks underlying or connected to our website.
    • All content of the website belongs to us. Except as may be permitted by law, you may not reproduce, modify, copy, de-compile or reverse engineer any of the materials, software or content on the website without our prior written permission.
    • You agree not to impersonate any other person while using this website, conduct yourself in an offensive manner while using our website, or use the website for any illegal, immoral or harmful purpose.
    • It is your responsibility to ensure your computer system meets all the necessary technical specifications to enable you to access and use the website and is compatible with the website.
    • We may, from time to time, restrict access to certain features, parts or content of the website, or the entire website, to users who have registered with us.
    • You are solely responsible for maintaining the confidentiality of your account and password, for all activity that takes place on your account, and for restricting access to your computer.
    • The information contained in this website is for general information purposes only. We endeavour to keep the information contained on the website up-to-date and correct, although there may be times when this is not the case.
    • Your access to our website may be restricted on occasion to allow for repairs or maintenance. We aim to correct errors and faults as soon as we can.
  3. Purchase
    • You are able to purchase individual products as and when from the “members shop” online. In the event that you purchase an individual item then these Terms and Conditions still apply.
    • If you register for a subscription account on the website you will be signed up to receive a regular delivery of our products dispatched on or about the 15th of each month. The account shall remain personal to you and is not transferable.
    • Your subscription request or request to purchase an individual product amounts to an offer to enter a contract to buy the products from us; you cannot then withdraw or cancel your order except as specifically stated in these Terms and Conditions.
    • Payment for the product or subscription will need to be made by you via Stripe payment and by using your debit or credit card in sterling. If you are outside the UK then all prices will be in sterling and any payment made will be converted with you agreeing to incur any related costs regarding currency conversion.
    • Payment can also be made by you for any products by way of a gift voucher provided it is valid and within date. Typically these expire after 12 months from purchase.
  4. Subscription Application
    • You must first register to set up an account with us by completing the registration form on the website. In order to register an account you must be an individual and agree to comply with these Terms and Conditions.  If you are registering on behalf of an organisation or company you must have the authority to bind that company.  By creating an account, you are confirming that you are 16 years of age or older.
    • When signing up you need to provide: your full name, current email address, delivery address and payment card details.
    • All information you provide to us when registering an account must be true and accurate. It is your responsibility to ensure the information in your account is updated regularly with any relevant changes.
    • We may refuse at our absolute discretion any application to subscribe to our services for any reason whatsoever.
    • Once your subscription is approved and set up for The Spice Pioneer we shall provide you each month with a selection of our chosen spices and flavourings with an easy to follow recipe to create your own meal each month all contained in a box delivered to your specified address. The recipes provided are inspired and are created by us based on our personal experience and knowledge and therefore may not necessarily be representative or authentic in terms of a particular region or style.
    • You are responsible for all activities and purchases that occur under your account. You must notify us immediately if you know of, or suspect, that anyone has obtained access to your account or if you otherwise become aware of any unauthorised use of your account or other security breach.
    • Subscriptions are on a fixed quarterly basis (ie: 3 months) and are then automatically renewed at the end of each quarterly period unless you wish to cancel your subscription in which case you should cancel via the members area on our website at least 48hours (2 days) prior to the renewal date.
    • Subscriptions can also be purchased by way of a gift for a family member or friend for fixed and non-renewable periods of 3, 6 and 12 months.
    • We select the contents of each monthly box and reserve the right to change or vary the contents of the box from time to time. A suggested music playlist selected by us will also be included through accessing our website members area.
  5. Delivery and Returns
    • Boxes can be delivered to addresses worldwide. Anything outside the United Kingdom (including Northern Ireland) will incur an additional delivery charge, as set out on our website.
    • Actual delivery times may vary for you depending on our stock availability and circumstances impacting upon delivery by postal service.
    • We reserve the right to use alternative delivery methods without prior notification.
    • You will not hold us responsible for any delays, outside our control, which relate to the delivery of boxes. Time shall not be of the essence.
    • It is your responsibility to report all lost or undelivered boxes online within 7 days of the expected day of delivery (therefore by 23rd of each month).
    • If your box does not fit through your letter box and you are out when it is delivered the postage provider will hold the box for [10] days before returning it to us and it is your responsibility to contact them to arrange receipt of the box as soon as you can. Due to the perishable nature of the food, we cannot be held responsible for refunding or replacing the box if this process has not been followed.
    • Where a box is first reported as lost, a replacement box will be provided to you and sent by post or courier at our sole discretion. We may also as an alternative provide a refund but this will be at our sole discretion.
    • If you change address, you must update your address details in the relevant section of the website to ensure that boxes are not sent out to the wrong address. Please ensure this is done in time to take effect before you move as you will not be refunded or credited for any boxes posted to the wrong location.
    • We reserve the right to cancel your account with us if it becomes apparent that, in our sole opinion, the postal service in your area is too unreliable and/or if more than two boxes have failed to arrive within twelve months.
    • If you are dissatisfied with any product you receive from us, please contact our customer services team. We retain the right to request a return of any faulty goods by recorded delivery to us.  If we request recorded delivery then we will pay for the cost of the postage on provision of the postage receipt.  If the fault is agreed, a full refund will be given for the returned goods.  Nothing in this section affects your legal rights.
  6. Limitations on Liability
    • Nothing in this clause 6 or otherwise in these Terms and Conditions shall exclude or in any way limit our liability for:
      • fraud or fraudulent misrepresentation;
      • death or personal injury caused by our negligence;
      • breach of any obligations implied by section 12 of the Sale of Goods Act 1979 o section 2 of the Supply of Goods and Services Act 1982;
      • under Part 1 of the Consumer Protection Act 1987; or
      • any other liability to the extent the same may not be excluded or limited as a matter of law.
    • None of these terms restrict any of your statutory rights.
    • Subject to clause 1, in no event shall we be liable to you for any business losses. Any liability we do have for losses you suffer is strictly limited to the purchase price of the relevant products and to losses that were foreseeable.  Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.  Please note that this does not affect your statutory rights.
    • With regards to any sale outside the UK, it is your responsibility to ensure that the products purchased by you comply with the local regulations relating to the importation of food stuffs and we cannot be liable for any breach of such import regulations.
  7. Cancellation
    • You may cancel your order or subscription within 14 days of applying for any reason. Thereafter, you are committed to the purchase or quarterly subscription (3 months).  The subscription is re-occurring and may only cancel during that period if we are in breach of our obligations to you.   You are at liberty to not renew after the quarterly period in accordance with 4.7 above.
    • In the event that you cancel your subscription within the 14 day cooling off period, we shall refund to you the full amount paid by you for the subscription on condition that you return the initial box to us in the same condition as dispatched to you within 14 days of cancellation. Should the box not be returned or if returned damaged in any way then we reserve the right to deduct an amount from the refunded amount to cover the price of the box and its contents and will then refund the remaining amount to you within 7 days.
    • We reserve the right to terminate the subscription if we believe you are in breach of your obligations to us. Should we terminate we shall refund only that part of the annual subscription that is remaining minus any loss we may have incurred as a result of your breach.
  8. Intellectual Property Rights
    • All intellectual property rights in or relating to the website and recipes (including our text, graphics, software, photographs and other images, videos, trade marks and logos) are owned by us or our licensors. Except where you are given a non-exclusive licence to use the intellectual property rights that you need to enable you to use the website in accordance with these Terms and Conditions, you are not given any rights in respect of the intellectual property rights owned by us or our licensors and you acknowledge and agree that you do not acquire any ownership of, or other rights in relation to, any such intellectual property rights by virtue of using the website.
    • If you provide us with any feedback, reviews, suggestions, ideas or information regarding the website or our service (“Feedback”), you agree and acknowledge that you assign all rights in the Feedback to us and that we have the right to use any such Feedback.
  9. Force Majeure
    • We shall not be liable for any lack of performance, or the unavailability of failure of our website where such lack, unavailability or failure arises from any cause reasonably beyond our control.
  10. Waiver

If we delay exercising or failing to exercise or enforce any right, such delay or failure shall not constitute a waiver of that right or any other rights under these Terms and Conditions.

  1. Applicable Law

Your use of this website is governed by these Terms and Conditions and construed and enforced in accordance with the laws of England and Wales.  Disputes arising from your use of this website and the services we provide are subject to the exclusive jurisdiction.

  1. Dispute Resolution

If you have any complaint then you should set your complaint out in writing and send this to us.  We shall do our best to resolve disputes within 30 days of receiving your complaint.  If the matter remains unresolved, you may refer the matter to an Alternative Dispute Resolution provider and can find details of such a provider at:
